Terms & Conditions:
1. We require 50% deposit minimum of $500 as a retainer.
2. All deposits and payments are non-refundable, in the event of a date change or wedding
cancellation for any reason.
3. Half the remaining balance is due two months prior to the wedding date. The remainder is due
on or before the wedding day. The balance owed must be received before any photographs will be
processed. No part of any order will be executed until the balance is paid in full.
4. Online proofs and high resolution digital files will be delivered in approximately four to six weeks
from the wedding date.
5. If Ivy Touch LLC is unable to perform to the guidelines of this contract due to a fire or other
casualty, strike, act of God, act of terrorism or other cause beyond the control of the parties,
Ivy Touch LLC shall have no further liability with respect to the agreement. If Ivy Touch LLC is
unable to perform to the obligations in this contract for any other reason, Ivy Touch LLC will not be
liable for costs in excess of the amount the client has paid. This limitation of liability will also apply in
the event that the high resolution digital files are lost through camera malfunction, damaged in
processing, lost in the mail, or otherwise damaged or lost with or without fault of the photographers
of Ivy Touch LLC. While every attempt is made to create the best images possible, no particular
photo is guaranteed.
6. In the event of one of the Ivy Touch's Photographer’s illness or other unforeseen circumstance,
Ivy Touch LLC may substitute another competent, professional photographer to take the
photographs place.
7. The client will obtain proofs and high resolution digital files which may be used for newspaper
announcements. Images may be used for personal use only, and may not be sold or published
without the written consent of Ivy Touch LLC.
8. All rights to images created by Ivy Touch LLC will remain with the photographer.
Ivy Touch LLC reserves the right to display any photographs made in conjunction with this
wedding as samples of his work for the purposes of window and showroom exhibit, advertising,
promotion on the internet, publication, instruction and professional competition.
9. Coverage plan times must be used consecutively. Time starts when photographers arrive
and the time finishes when the coverage time runs out. If the photographers need to stay longer,
the client will be expected to pay overtime @ $200 per hour in 15 minutes increments.
10. The Client understands that they are responsible to provide vendor meal for both
photographers.
11. The Client understands that due to the inherent qualities of photographic dyes and materials,
the photographs may fade or discolor over time. The Client agrees to release the Ivy Touch LLC
from any liability for any claims based whatsoever upon fading or discoloration
due to such inherent qualities. If during the wedding ceremony flash photography is not allowed,
the Client understands that high ISO settings must be used creating a pixilated or grainy effect in
the photographs.
12. Any changes to this Agreement must be in writing and signed by both parties. This
Agreement incorporates the entire understanding of the parties and is governed by the laws of the
State of Connecticut.
By signing of this contract the photographer and the clients agree to all terms & conditions stated
in this contract.
